Within the area Legal & Compliance Financials Services, Treasury & Asia we are responsible for the Legal & Compliance activities of Bharat Benz in India and abroad.

The Objective of the position is to support the local DICV Legal & Compliance Team in handling of the increasingly important area on Legal & Compliance Product to support and local business unit and Management in steering of respective product related legal risks during the complete vehicle lifecycle.

As part of our Global Daimler Truck Legal & Compliance Network you will also closely cooperate and communicate with the Global Legal & Compliance Team of Daimler Truck AG in Germany and Daimler Truck Group worldwide.

Responsibilities

SCOPE OF RESPONSIBILITY

  • Understand and implement the Global Daimler Truck Product Compliance Policy and follow the Rules of Procedure in conducting the Product Compliance committee meetings for all Safety, Regulatory Conformity and Emission (SCE) related topics.
  • Legal & Compliance consultation to management and employees and support management in taking over responsibility for Product compliance.
  • Provide advice in terms of product related legal inquiries and processes as well as legal consultation in the application of Regulatory requirements and standards.
  • Provide legal expertise and advice on questions in the context of product development and Field Vehicles.
  • Provide guidance in legal grey areas (legal requirements and/or internal guidelines). Ongoing monitoring, analysis and assessment of relevant legal frameworks including current developments in legislation. Derive a legal assessment of risks, development of methods, processes and systems as well as guidelines and legal advisory opinions.
  • Create risk awareness in non-legal business areas & units.
  • Be part of the DICV local clearing team and involve in assessment of the clearing cases in coordination with PCMS R & D team, clearing team and clearing teams in HQ.
  • Present the legal team in the recall decision making committee of DICV and support the assessment of the screening cases in coordination with PCMS R & D team, After Sales and align where relevant with HQ teams.
  • Support development of Product Compliance Management Systems in order to avoid liability and reputational risks.
  • Ensuring all updates on Control measures and process from HQ are updated to the relevant function and providing adequate support for completion of the process and controls.
  • Support Business in conducting Recall & Service Measure Procedures including reporting to respective authorities in relevant markets: Develop and implement procedures for product recalls, service measures in case of identified safety, regulatory conformity & emissions issues. As per HQ guidance set-up respective Special Incident Reporting (SIR) considering diverse reporting deadlines per in-use markets and set-up and maintain exchanges with relevant local authorities.

R & D LEGAL TOPICS- SUPPORT FROM LEGAL

  • Support to the R &D team on various legal related R &D queries and providing legal opinion on new laws/regulations and sharing legal feedback with respect to any grey area in any Act/Regulation.
  • Support and providing legal feedback on communications to Authorities/Ministry / SIAM.
  • Updating the team on latest changes in relevant laws/Acts/Judgements and sharing legal feedback for the queries raised.

HANDLING PRODUCT LITIGATION

  • Handling Product Litigations filed against the Company.
  • Evaluate legal claims and strategize handling of litigation also in close collaboration with other team members in the local Legal & Compliance team, in HQ or other markets.
  • Identify and evaluate lawyers for engaging them for handling litigations.
  • Draft/Vet written statements, counters, rejoinders etc.
  • Legal research and advise lawyers on the legal precedents.
  • Close follow-up with lawyers till risks in the litigations are adequately mitigated.

Qualifications

Any additional technical qualification and working experience in a OEM or a Manufacturing organization with sound technical knowledge will be an added advantage

  • Bachelor’s or Master’s degree in law(Mandatory)
  • Minimum 8-10 years’ experience in a legal practice (some in-house experience preferred but not necessary).
  • Strong strategic and stakeholder management skills.
  • Strong writing and communication skills.
  • High attention to detail. Able to provide advice during projects and support issues.
  • Strong problem solving / troubleshooting skills. Strong customer-facing and interpersonal skills.
  • Motivated and exceptional organisational and time management skills.
  • Ability to priorities, multi-task, work under pressure, and deliver work under a tight schedule.
